Terms of Service for Nuru Found Organization

These Terms of Service ("Terms") govern your access to and use of nurufoundations.com and its learning platform, including course enrollment, student/tutor dashboards, and community features (together, the "Platform"), operated by Nuru Found Organization ("we", "us", "our"). By creating an account or using the Platform, you agree to these Terms.

1. Eligibility and Minors

The Platform is used by students of varying ages, including students under 18. Where a student is a minor, enrollment and use of the Platform must be authorized by a parent, guardian, or enrolling school, who accepts these Terms on the student's behalf and is responsible for the student's compliance with them.

2. Your Account

You must provide accurate registration information (including your name, email, and phone number) and keep your password confidential. You are responsible for all activity that happens under your account. Tell us right away at info@nurufoundation.org if you suspect unauthorized use of your account.

3. Course Enrollment and Access

Enrolling in a course grants you a personal, non-transferable license to access that course's materials for your own learning while your account is active and in good standing. You may not copy, redistribute, resell, or publicly share course materials, videos, or notes without our written permission.

4. Fees and Payment

Course fees are billed in monthly installments. Each installment has a due date; unpaid installments may be granted a grace period, after which access to the related course may be locked until payment is made. Payments are currently accepted via M-Pesa and any other payment method we make available on the Platform.

Refunds, where applicable, are considered on a case-by-case basis — contact us at info@nurufoundation.org to discuss a specific situation.

5. Assignments and Submissions

You retain ownership of the work (including code) you submit for assignments. By submitting it, you grant Nuru Found Organization and your assigned tutors a license to review, grade, store, and provide feedback on that work as part of the course.

6. Community Conduct

If you use our forum, messaging, or comment features, you agree not to post content that is abusive, harassing, plagiarized, or unlawful. We may moderate, remove content, or suspend accounts that violate this rule, to keep the Platform safe for all learners, including minors.

7. Intellectual Property

Course content, videos, branding, and site materials are owned by Nuru Found Organization or our content partners and are protected by copyright. Except for the limited access license described above, no rights are transferred to you.

8. Disclaimer of Warranties

The Platform is provided "as is." While we work to keep course materials accurate and the Platform available, we do not guarantee that the Platform will be uninterrupted, error-free, or that it will meet every learning outcome you expect.

9. Limitation of Liability

To the extent permitted by Kenyan law, Nuru Found Organization is not liable for indirect or consequential damages arising from your use of the Platform. Nothing in these Terms limits liability that cannot lawfully be limited.

10. Third-Party Links

The Platform may link to third-party sites (e.g. social media). We are not responsible for the content or practices of sites we do not control.

11. Termination

We may suspend or terminate an account that violates these Terms, engages in unsafe conduct toward other users (including minors), or has significantly overdue payments, after reasonable notice where practical.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of Kenya, and any disputes are subject to the exclusive jurisdiction of the courts of Kenya.
